Brandishing is often a wobbler, and depending on the mood of the DA you'll find yourself in prison in many cases. Generally there has to be a reasonable threat to your life in order to justify brandishing.
Ight so, the 21 foot rule is a myth. There's a YouTuber called Hard2Hurt (his name is IcyMike) who did a video about it. If you do fighting stuff he's a great guy to be subscribed to, I do Muay Thai and some of his little tricks have really helped me out.
Secondly, idk about other states, but I may states it's only considered brandishing if it's in front of at least 2 people. Also, he's own his own property, and not states won't consider that brandishing.

You cannot kill someone for committing a misdemeanor in most states. Castle doctrine also often does not apply to your driveway, yard, or porch.
Depends on the state. Texas is actually the only one I'm aware of that would allow you to protect your property from theft with lethal force. Self defense would otherwise require there to be a danger to life - and only human life, pets are property.

People have been arrested for such things as adding a row of barbed wire to stop thieves from stealing vegetables from their gardens. Criminals are literally protected by law to do whatever they wish.
Even pepper spray is outlawed for self defense. In an argument with a Brit, I sent them an article where a 16 year old girl was arrested for using pepper spray to stop her would-be rapist from attacking her. If the thief decided to get even more stupid and react to getting caught by attacking, then shooting him would be a clear case of self defense.
If the thief simply ran away then shooting him in the back would be both illegal and immoral.
This guy did the right thing by having his gun ready when confronting a potential threat, and he also did the right thing by recognizing that the potential threat was not becoming an immediate threat.
He should have told the guy to drop the box where he was and leave though, because allowing a potential threat to get so close was a risky mistake.
